Pandemic and Constitution. Appeal of the Legal Sciences Committee of the Polish Academy of Sciences

Combating the SARS-CoV-2 coronavirus is a challenge for all societies and governments. “The Constitution of the Republic of Poland provides for appropriate extraordinary instruments, but the state authorities do not use them,” – says the Legal Sciences Committee of the Polish Academy of Sciences (PAN) in its statement and is calling for immediate compliance with the activities of state organs with the Constitutional Law.

The Constitution of the Republic of Poland provides for extraordinary instruments, but the state authorities do not use them. Moreover, they are conducting further disproportionate restrictions on the freedoms and rights of individuals, but they do not bring effective measures to protect human rights. The scope, time of application of these solutions, as well as the actual intentions of the legislator raise many doubts – says the resolution of the Committee of Legal Sciences of the Polish Academy of Sciences.

In the Committee’s opinion, “the combat against the threat to life and for health of citizens in Poland is continued in parallel with the preparations for the elections,” and therefore “the spreading pandemic is annulling the possibility of implementing the election schedule.”
